chairman

My dear fellow exporters,

The Government has decided to roll-out Goods and Services Tax (GST) from July 1, 2017. While this is a major indirect tax reform, there are likely to be many implementing issues.

Though exports have been kept zero-rated in the upcoming GST, exporters will however have to first pay the GST at varying rates and then claim refunds which would add to their cost of shipments. The problem is more serious in case of merchant exporters who at present are exempted from paying taxes on their domestic purchases.

Further, the past experience of claiming refunds does not enthuse the exporters. A delay in refund would cause problem for the exporters/manufacturer in maintaining the working capital and cash flow. Currently there is delay in months in providing the refund to the exporters/manufacturers. There should be strict regulation in the processing of refund under GST.

The biggest uncertainty would be the problem of classification of thousands of items manufactured by the trade and industry. Several items are capable of dual classification and there is no clear cut distinction between the products.

With respect to advance authorisation, only the basic customs duty will be exempted but the authorisation holders will have to pay GST (IGST) on the current CVD and additional excise duty. This will be a major blow for engineering exporters who import steel using AA, as Indian steel prices are much higher than international prices due to the protection given to the Indian steel industry. This would make this route totally unviable and would mean a cash outflow at the time of import.

We also don’t have proper clarity on EPCG (Export Promotion Capital Goods) scheme under the GST regime.

On behalf of EEPC India we hope that the GST Council will address these issues from an exporter-friendly perspective.
