My dear fellow exporters,

The Centre has modified existing export incentive schemes removing most exemptions provided on input taxes to align them with the Goods & Services Tax (GST) regime which has rolled in from July 1. Exporters importing inputs including machinery under popular schemes such as Advance Authorization (AA) and Export Promotion Capital Goods (EPCG) Scheme without paying import duties (customs duty, countervailing duty and special additional duty) up to a given limit will now have to pay GST on it and later apply for refund.

According to a recent notification issued by DGFT, under the GST regime, no exemption from payment of Integrated GST (IGST) and compensation cess would be available for imports under Advance Authorization. Importers would need to pay IGST and take input tax credit as applicable under GST.

However, imports under Advance Authorization would continue to be exempted from payment of basic customs duty, additional customs duty and education cess. Exemptions will also be provided wherever penal duties such as anti-dumping, safeguard and transition product specific safeguard duty are applicable.

The notification added that under the EPCG scheme (Chapter 5 of the FTP), too, importers of capital goods would need to pay IGST and take input tax credit.

Benefits under the Merchandise Export from India Scheme (MEIS) and the Services Export from India Scheme (SEIS), which provides exporters with duty free scrips based on the value of their exports, have also been curtailed. The scrips cannot be used for payment of IGST and GST compensation cess in imports, and CGST, SGST, IGST and GST compensation cess for domestic procurement

Imports by Export Oriented Units (EOUs), which were allowed duty free imports of goods for their authorized operations, will now get exemption on only the customs duty. Such goods would attract integrated tax and compensation cess. The taxes so paid on imports will be neutralized by ITC (input tax credit).

Trade – In Jan-April 2017, India France bilateral trade stood at € 3.46 billion (+28.14%) as compared to the corresponding period the previous year. India’s exports to France increased by 13.77% during this period with a rise in exports of following top 10 category products: mineral fuels & oils (109.78%); nuclear reactors, boilers, machinery and mechanical appliances (3.95%); automobiles and parts (52%); electrical machinery (10.28%); gems and jewellery (9.74%). However there was a drop in exports of knitted or crocheted articles of apparel & clothing accessories (-2.99%), not knitted or crocheted articles of apparel & clothing accessories (-0.93%), footwear (-1.7%) and & articles of leather (-1.09%).

Meanwhile, French exports to India increased by 51.1% during the same period: Exports of following top 10 ranked products increased: aircraft & spacecraft (181.03%); electrical machinery & equipment (18.13%); nuclear reactors, boilers, machinery & mechanical appliances (129.14%); pharmaceutical products (45.92%); miscellaneous chemical products (14.61%); automobiles and components (23.41) & plastics and articles thereof (8.89%). However, exports of organic chemicals fell by 12.29%, iron & steel (-19.79%); and those of optical, photographic, cinematographic, measuring, checking, precision, medical or surgical instruments and apparatus & parts thereof by -32.82%.

Investment – According to statistics released by Business France, “There are over 150 Indian companies operating in France, where they employ more than 7,000 people. Eleven new investments from India were recorded in 2016, creating or maintaining 171 jobs. Indian investments in France in 2016 were often in high value-added activities, particularly R&D and engineering (36%), decision-making centres (27%), including a European headquarters, and business services (18%). Investments came in a variety of sectors, including software and IT services (18%), energy and recycling (18%), aerospace, naval and railway equipment (18%), and textiles and clothing (18%) sectors. Indian companies invested primarily in the Auvergne-Rhône-Alpes (27%), Ile de France (Paris region) (27%) and BourgogneFranche-Comté (18%) regions. Selected investment projects in 2016 were from:

Royal Enfield [in 2016 this Indian firm announced that it would be establishing its pan-European headquarters in Paris (Ile de France region), with the opening of a concept store in Levallois-Perret]. Guesswork [a winner in French Tech Ticket, season 1, this Indian start-up markets a mobile app that helps small online retailers connect with customers. Guesswork won a one-year residency for 2016 in the Startup42 business incubator in the Parisian suburb of Kremlin-Bicêtre (Ile de France region)]. Etosha: [this specialist in flavours, fragrances and essential oils for agri-food, personal care (deodorants, perfumes and soaps) and homecare (detergents) recently established a French subsidiary in Grasse (ProvenceAlpes-Côte d’Azur region) that will create 10 jobs over the next three years]. Dymond Cleantech: [a winner in French Tech Ticket, season 1, this Indian start-up has developed an electrochemical water purification technology based on diamond electrodes. In 2016, it was resident in the La Paillasse business incubator in Paris (Ile de France region), where it had co-working space and access to coaching sessions].

The agreement signed by India with Romania on promotion and guarantee of investments to end its validity

The Romanian Embassy in New Delhi revealed that the agreement regarding the promotion and the guarantee of investments signed by India with Romania could end its validity in May. It was reported by the Embassy that : ‘Despite numerous actions undertaken by the EU to convince the Indian authorities to stop the unilateral annulment of the agreements regarding the promotion and guarantee of investments signed by India with the member states, no concession was obtained on the part of India. In this situation, the bilateral agreement for investment signed between India and the Netherlands ended its validity in January 2017 while in March, April and May other agreements signed with 22 member states stop their validity among which Romania’.

According to the Embassy, the ministers of finance and commerce of India consider that the old agreements are outdated and, as such, new documents must be signed which should reflect the economic reality and the progress of the latest years. ‘The cabinet of the Indian prime minister agreed on a model text which was sent to the partner countries for analysis and negotiation. The issue in the negotiation with the European states is that this issue is of the competence of the European Commission and not every individual state. In the relation with India, there are negotiations started for the signing of an agreement for free commerce which include the signing of an agreement for free commerce which includes a section dedicated to foreign investments, but these discussions are practically stopped, the parties having different opinions as regards the sensitive aspects such as: vehicles, alcoholic beverages, public procurement etc. In this context, no section referring to investments can be finalised. Until a solution can be found by both parties and in the perspective of ending validity, the bilateral existing agreements, the new investments which are made in India on the part of the companies resident in the member states of the European Union will no longer by covered by the judicial framework. This is valid for the Indian companies which intend to operate investments in the EU. Romania is under the same incidence as any other member state’ says the quoted source.

EXPORTS (including re-exports)

In consonance with the revival exhibited by exports in the last three months, during December,2016 exports continue to show a positive growth of 5.72 % in dollar terms (valued at US$ 23884.97 million) and 7.79 per cent in Rupee terms (valued at Rs. 162179.89 crore) as compared to US$ 22593.35 million (Rs. 150461.57 crore) during December,2015. Cumulative value of exports for the period April-December 2016-17 was US$ 198807.75 million (Rs. 1333913.57 crore) as against US$ 197333.62 million (Rs. 1278004.37 crore) registering a positive growth of 0.75 per cent in Dollar terms and positive growth of 4.37 per cent in Rupee terms over the same period last year. Non-petroleum exports in December 2016 were valued at US$ 21117.73 million against US$ 20036.19 million in December 2015, an increase of 5.4 %. Non-petroleum exports during April - December 2016-17 were valued at US$ 176831.24 million as compared to US$ 172960.12 million for the corresponding period in 2015, an increase of 2.2%. The growth in exports is negative for USA (-1.21%),China(-7.45%) and EU(-6.27%) but exhibited positive growth in case of Japan(3.79%) for October 2016 over the corresponding period of previous year as per latest WTO statistics.

IMPORTS - Imports during December 2016 were valued at US$ 34254.32 million (Rs. 232588.18 crore) which was 0.46 per cent higher in Dollar terms and 2.43 per cent higher in Rupee terms over the level of imports valued at US$ 34096.49 million (Rs. 227067.28 crore) in December, 2015. Cumulative value of imports for the period April-December 2016-17 was US$ 275355.92 million (Rs. 1848099.10 crore) as against US$ 297410.85 million (Rs. 1926024.55 crore) registering a negative growth of 7.42 per cent in Dollar terms and 4.05 per cent in Rupee terms over the same period last year.
